I have the honour to report the following case:-

On the 5th November, 1910, two newly arrived Sappers of the 25th Company, Royal Engineers were sent out to join a de- tachment then working on the preparation of gun mountings on Mount Davis. They made a certain statement to their Division- al Officer, a copy of whose report with the recorded statements of the two Sappers is attached.

From this it will be seen that on the 5th November, 1910,

a certain German, Mr. Heermann, son of the manager (possibly partner) of the firm of Gaupp & Co, a well-known firm of opti- cians and chart sellers of long standing in Hong Kong, was in possession of a large scale plan of the Mount Davis Defences at the Western entrance of the harbour, and possibly also of a plan of Devil's Peak Defences at the Eastern entrance. It is curious that he should have openly shown the former plan

to the two soldiers.

I would here remark that owing to the configuration of

Island the land of Hong Kong/and on the Mainland, it is easy for any

one to see all our guns and gun emplacements from the tops of

numerous hills, whence also they might be located by triangu-

lation.

The case was referred to His Excellency the Governor, who,

after consultation with the Hon. The Attorney General, came to
